Praying Mantis Collective LLC d/b/a Mantodea
Please read carefully. This agreement affects your legal rights, including your right to sue.
When you accept this agreement in the Mantodea app, we collect your full legal name, date of birth, phone, email, and an emergency contact name and phone.
I voluntarily choose to participate in activities offered, hosted, taught, or arranged by Praying Mantis Collective LLC d/b/a Mantodea (collectively, "Mantodea"), whether at the Mantodea studio, outdoors, at a partner venue, online, or at another location. Covered activities include yoga, movement, stretching, strength or sculpt classes, meditation, breathwork, sound baths/sound healing, workshops, retreats, community events, and related use of props, equipment, facilities, and premises (collectively, the "Activities").
I understand that Mantodea and its instructors are not medical providers and do not diagnose, treat, or prescribe for any condition.
I am responsible for deciding whether I am physically and mentally able to participate. I will consult a qualified healthcare professional before participating if I am pregnant, recently postpartum, recovering from surgery or injury, have a medical condition, take medication that may affect participation, or have been advised to restrict activity.
I will inform the instructor before class of any injury, pregnancy, recent procedure, condition, limitation, dizziness, pain, or other concern that may affect safe participation. I understand that sharing information does not transfer responsibility for my health decisions to Mantodea.
I will follow safety instructions, use equipment as directed, stay within my abilities, request modifications when needed, and stop immediately if I experience pain, faintness, shortness of breath beyond normal exertion, or other concerning symptoms.
Hands-on assistance is optional. I may decline or withdraw consent to physical assists at any time without affecting my ability to participate.
I understand that participation involves inherent and other risks, both known and unknown, that cannot be completely eliminated. These may include slips, trips, falls, collisions, overexertion, muscle strains or tears, sprains, fractures, joint or spinal injury, aggravation of an existing condition, dizziness, fainting, emotional discomfort, hearing sensitivity or discomfort from sound, allergic or environmental reactions, illness exposure, property damage, serious injury, disability, or death. Outdoor and off-site Activities may also involve weather, heat, cold, uneven ground, insects, traffic, water, fire, transportation, and conditions controlled by third parties.
I KNOWINGLY AND VOLUNTARILY ACCEPT AND ASSUME ALL RISKS OF PARTICIPATION, WHETHER KNOWN OR UNKNOWN, INHERENT OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY NORTH CAROLINA LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Mantodea; Praying Mantis Collective LLC; their owners, members, managers, employees, instructors, contractors, volunteers, agents, landlords, property owners, host venues, event partners, sponsors, and their respective insurers, successors, and assigns (collectively, the "Released Parties") from claims, demands, causes of action, damages, losses, or expenses arising from or related to my participation in the Activities or presence on the premises, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, including negligent instruction, supervision, maintenance, selection of equipment, or premises conditions.
This release does not apply to gross negligence, willful or wanton conduct, intentional misconduct, or any liability that cannot legally be waived.
I am responsible for my personal belongings. To the fullest extent permitted by law, I release the Released Parties from claims for loss, theft, or damage to personal property. I understand that third-party venues, vendors, practitioners, transportation providers, and event partners may have separate terms and are responsible for their own services.
If I become ill or injured and cannot make or communicate decisions, I authorize Mantodea personnel to contact emergency services and my emergency contact and to provide reasonable first aid within their training. I understand Mantodea is not obligated to provide medical care and that I am responsible for resulting medical or transportation costs. This authorization does not create a duty beyond that imposed by law.
I understand that participation in group or shared-space Activities may expose me to communicable illnesses. I agree not to attend when I have symptoms of a contagious illness or when attendance would violate current public-health requirements. I voluntarily accept the ordinary risks associated with shared spaces.
This Agreement is governed by North Carolina law. Any permitted legal action relating to this Agreement shall be brought in a court of competent jurisdiction in Mecklenburg County, North Carolina. If any provision is found unenforceable, it shall be limited or severed to the minimum extent necessary, and the remaining provisions will remain effective. This Agreement is the complete agreement concerning the subjects it covers and may be changed only in a writing accepted by Mantodea and the participant.
This Agreement applies to all Activities occurring on or after the signature date and remains effective until I revoke it in writing for future Activities. Revocation does not affect Activities occurring before Mantodea receives it. I consent to electronic records and signatures and understand that typing my name, checking an acceptance box, or applying an electronic signature is intended as my legal signature. I may request a copy of this Agreement.
I CONFIRM THAT I HAVE READ THIS ENTIRE AGREEMENT, UNDERSTAND IT, HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS, AND SIGN IT FREELY. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.
